Akta Perlindungan Data Peribadi kuat kuasa 15 Nov


PUTRAJAYA - Kementerian Komunikasi dan Multimedia (KKMM) hari ini mengumumkan 15 November lalu sebagai tarikh penguatkuasaan Akta Perlindungan Data Peribadi 2010 (Akta 709), diperkenalkan khusus bagi mencegah penyalahgunaan data peribadi orang awam untuk tujuan komersial.
 
Selaras dengan penguatkuasaan akta itu, semua pihak yang dikategorikan sebagai pengguna data di bawah Perintah Golongan Pengguna Data kini diberi tempoh sehingga 15 Feb tahun depan untuk mendaftar dengan Jabatan Perlindungan Data Peribadi Malaysia (JPDPM), dan menjadi kesalahan bagi mereka mendedahkan data peribadi kepada pihak ketiga tanpa persetujuan pemilik.
 
Menteri Komunikasi dan Multimedia, Datuk Seri Ahmad Shabery Cheek yang membuat pengumuman itu berkata akta diluluskan pada April 2010 itu merupakan sebahagian matlamat dasar ke-10 Akta Komunikasi dan Multimedia 1998, iaitu bagi menjamin keselamatan maklumat serta kebolehpercayaan dan keutuhan rangkaian dalam perlindungan data di Malaysia.
 
Beliau berkata Malaysia merupakan negara pertama di kalangan negara anggota Asean yang menguatkuasakan akta seumpama itu, sekali gus menjadikan objektif transformasi Malaysia ke arah menjadi sebuah negara maju dalam dunia Hab Dunia ICT, bakal menjadi kenyataan.
 
"Melindungi maklumat data peribadi adalah suatu tanggungjawab sosial yang besar kerana Industri Besar Data (Big Data) di Malaysia sedang berkembang pesat, dan ia turut merangkumi soal data-data peribadi serta maklumat penting sesebuah organisasi,"  katanya dalam sidang media di KKMM di sini. 
 
Ahmad Shabery menganggarkan ketika ini terdapat kira-kira 25,000 institusi dalam negara yang dikategorikan sebagai pengguna data yang perlu mendaftar dengan JPDPM dan mematuhi akta itu.
Menjawab satu soalan mengenai keseriusan masalah berkaitan pembocoran maklumat data peribadi, katanya beliau difahamkan setiap bulan pihak 'Cyber Security' menerima antara 800 hingga 1,000 aduan berhubung maklumat peribadi individu yang disalurkan kepada pihak tidak sepatutnya.
 
Ahmad Shabery seterusnya mengumumkan pelantikan Ketua Pengarah JPDPM, Abu Hassan Ismail sebagai Pesuruhjaya Perlindungan Data Peribadi yang pertama, yang akan bertindak memastikan kelancaran pelaksanaan akta itu.
 
Sementara itu, JPDPM dalam siaran medianya mentakrifkan pengguna data sebagai pihak yang memproses apa-apa data peribadi atau mempunyai kawalan terhadap data berkenaan, atau membenarkan pemprosesan apa-apa data peribadi.
 
Ia turut menyenaraikan 11 sektor sebagai klasifikasi Golongan Pengguna Data, yang merangkumi sektor komunikasi, perbankan serta institusi kewangan, insurans, kesihatan, pelancongan serta hospitaliti, pengangkutan, pendidikan, jualan langsung, perkhidmatan, hartanah dan utiliti. 
 
Ia turut menyenaraikan pelbagai kesalahan serta penalti di bawah akta berkenaan, termasuk hukuman denda tidak melebihi RM500,000 atau penjara tidak lebih tiga tahun bagi kesalahan memproses data peribadi tanpa perakuan pendaftaran atau selepas pendaftaran dibatalkan, serta denda tidak lebih RM200,000 atau penjara tidak lebih dua tahun atau kedua-duanya bagi kesalahan tidak mematuhi notis penguatkuasaan atau kehendak Pesuruhjaya. - Bernama

Awas kepada pengguna data yang mendedahkan maklumat peribadi individu kepada orang ketiga tanpa persetujuan pemilik untuk tujuan komersial kerana mereka boleh berdepan tindakan tegas berikutan penguatkuasaan Akta Perlindungan Data Peribadi 2010 (Akta 709) pada 15 November lalu.

Menteri Komunikasi dan Multimedia Datuk Seri Ahmad Shabery Cheek berkata, akta itu digunakan untuk menjamin keselamatan maklumat dan kebolehpercayaan serta keutuhan rangkaian dalam perlindungan data di negara ini.

"Menerusi akta berkenaan, mereka yang mempunyai data pengguna dari 11 sektor seperti komunikasi, insurans, perkhidmatan dan jualan langsung akan lebih bertanggungjawab dalam memberikan maklumat peribadi individu kepada pihak luar.

"Semua data peribadi yang dilindungi mengikut Akta 709 termasuk nama, alamat, nombor kad pengenalan, nombor pasport, maklumat kesihatan, e-mel, gambar, imej rakaman kamera litar tertutup (CCTV) dan maklumat dalam fail peribadi," katanya pada sidang media mengumumkan Pelaksanaan Penguatkuasaan Akta Perlindungan Data Peribadi Malaysia 2010 (Akta 709), semalam.

Turut hadir, Pesuruhjaya Perlindungan Data Peribadi Malaysia Abu Hassan Ismail.

Ahmad Shabery berkata, selaras dengan penguatkuasaan akta itu, semua pihak yang dikategorikan sebagai pengguna data di bawah Perintah Golongan Pengguna Data kini diberi tempoh sehingga 15 Februari tahun depan untuk mendaftar dengan Jabatan Perlindungan Data Peribadi Malaysia (JPDPM).

"Bagi tujuan berkenaan, pendaftaran pengguna data adalah terbuka kepada individu atau organisasi yang memproses data peribadi dalam transaksi komersial seperti mana yang dinyatakan dalam perintah golongan pengguna data.

"Kegagalan berbuat demikian boleh dikenakan penalti iaitu denda tidak melebihi RM500,000 atau penjara tidak melebihi tiga tahun atau kedua-duanya bagi kesalahan memproses data peribadi tanpa perakuan pendaftaran atau selepas pendaftaran dibatalkan, serta denda tidak lebih RM200,000 atau penjara tidak lebih dua tahun atau kedua-duanya bagi kesalahan tidak mematuhi notis penguatkuasaan atau kehendak Pesuruhjaya," katanya.

Menurutnya, setiap bulan Cyber Security menerima kira-kira 1,000 aduan kebocoran maklumat peribadi individu kepada pihak ketiga untuk tujuan komersial. - HM

Information that would be collected by us includes but not limited to your personal identifiable information, contact details and email address.
Use of information collection
Generally, we use your information for administrative purpose e.g. processing, confirming, fulfilling and completing your transactions and requests for our services. In the event there is alteration / change of flight schedule, we will use information provided by you while making your reservation through our official website @ www.airasia.com, our call centre, our sales counter, to contact and notify you of the alteration / change. Information of children under the age of 13 would only be collected to facilitate online bookings of flight or room reservation. Such information should only and would normally be provided by the parent or guardian of someone under 13 years old. In addition, only limited information of the child such as name, age, date of birth, traveling document, would be collected by AirAsia.
If you are a Parent of Guardian of someone under 13 years old who has provided us information without your knowledge and consent, you may request that we remove this information by contacting us at online feedback form.
